Transition 5.0 and tax credits: how they work

On Feb. 26, 2024, the launch of the Transition 5.0 plan was published on the MIMIT website : 13 billion in total for businesses including 6.3 billion for the Green and Digital Challenge.

Let’s find out in detail how the incentives work.

Already, the Transition 4.0 plan has proposed various business-related incentives.

Today, included within the PNRR DECREE, the Transition 5.0 plan is an important incentive tool for companies dedicated to the joint challenge of ecological and digital transition.

Minister of Enterprise and Made in Italy, Adolfo Urso also talks about “preparing adequate training for workers to acquire the skills suitable for the geo-economic transition that is taking place.”

Key features include offering significant tax credits, up to 45 percent, for energy-saving targeted investments made by businesses.

The program, aimed at stimulating investment in the 2024-2025 biennium in innovative projects aimed at reducing energy consumption, will not actually come into effect until after the still-pending implementing decrees are issued.

What assets are covered by the relief?

Eligible investments cover both tangible and intangible assets, new and instrumental to business operations, as specified in Annexes A and B to Law 232/2016, also known as the Impresa 4.0 law.

These investments must be integrated into the company’s production management system or supply network and must result in a reduction in the overall energy consumption of the production facility of not less than 3 percent, or alternatively, a reduction in the energy consumption of the processes involved of not less than 5 percent.

In addition, the following are eligible for relief:

1) Investment in new capital goods necessary for independent production of energy from renewable sources, including storage facilities.

2) Expenditure on employee training aimed at acquiring or consolidating skills in technologies for the digital and energy transition of production processes.

What is the tax benefit obtainable in tax credit?

The tax credit varies according to the amount of investment and the percentage of energy consumption reduction that can be achieved.

For investments up to 2.5 million euros, the tax credit is 35 percent of the cost, while for investments over 10 million euros it is 5 percent. These percentages increase to 45% when energy consumption is reduced by more than 10%.

The credit can be used through offsetting by submitting the F24 form in a lump sum. Any surplus not offset by December 31, 2025 may be deferred in 5 equal annual installments.

What are the ways to access the grant?

Interested enterprises must submit special communications to the Ministry of Enterprise and Made in Italy once the investments are completed.

Recognition of the tax credit is subject to the submission of certifications by an independent evaluator attesting to the reduction in energy consumption expected from the investments.

The credit for certification fees is an important support for SMEs, fostering:

  1. Accounting regularity: certification ensures that accounting records are correct.
  2. Access to credit: Regular accounting facilitates access to bank credit.
  3. Participation in public tenders: certification is often a requirement to participate in public tenders.

What is the mode of use of the tax credit?

The tax credit can be offset via F24 form by Dec. 31, 2025, with the possibility of carrying the excess forward for five years.

Important: Assignment or transfer of tax credits is not allowed, and such credits are reduced if the subsidized assets are sold or used for purposes unrelated to the business activity.

The following are expected two implementing decrees that will establish details regarding reporting and certification methods, criteria for energy savings, tax credit granting and control, expenditure limit, certifier requirements, non-eligible investments, and contribution to the climate goals of the Recovery plan, as well as the requirements for subsidized training.

In addition:

  • For SMEs required to have a statutory audit, the increase in tax credit is for an amount not exceeding 10,000 euros.
  • For SMEs not required to have a statutory audit, the increase in tax credit is for an amount not exceeding 5,000 euros.

Certification by an auditor is required.

The regulatory wording must be indicated on invoices, transport documents and other documents related to the acquisition of the subsidized goods.

The actual incurrence of the expense and its correspondence to the accounting records must be substantiated by an appropriate certification issued by a certified public accountant or auditing firm.

Finally, it should be pointed out that regarding the compatibility of the new facility, it cannot be combined for the same eligible expenses with:

  1. The investment bonus provided by Article 1, paragraphs 1051 et seq. of Law no. 178/2020.
  2. The bonus for Special Economic Zones (SEZs) single Mezzogiorno provided by Article 16 of Decree Law No. 124/2023.

In other words:

  • It is not possible to take advantage of the new facility and the investment bonus for the same expenses at the same time.
  • It is not possible to take advantage of the new facility and the single SEZ bonus Mezzogiorno at the same time for the same expenses.

For example, if an enterprise incurs an eligible expense for the purchase of a new piece of machinery, it may choose to benefit:

  • Or the investment bonus;
  • Or of the new facilitation.

It is not possible to claim both benefits for the same expense.
